    Aju Jacob ConsultantAju Jacob

    Aju is a Delay Analyst and an experienced planner from an engineering background working with leading contracting organisations in the UK across multiple sectors, including Rail, Civils and Highways. This comprises engagements with clients, main contractors, and consultants.

    Commencing his career as a site engineer working in the highways sector, Aju quickly progressed to become a section engineer responsible for platform extension works. However, Aju developed a keen interest in planning and was soon offered a position as a Planner, initially working on a tunnelling project. Aju’s experience working within project controls and planning, combined with his practical background, has given him a breadth of experience and a keen eye to analyse construction projects and establish entitlement.

    Aju also has a strong understanding of all standard form contracts with a particular focus on the NEC, having been actively involved in its administration during the course of his career. He has also produced period-end programmes, cost, change impact, Entitlement assessment, performance, and risk deliverables within an NEC framework.

    Aju is an expert in Primavera P6 and is proficient with all commonly used planning and project controls software tools, including ASTA Powerproject, Acumen Fuse, TILOS and MS Project. Aju has also used his practical experience to undertake earned value analysis, risk management and has also undertaken forensic analysis of events during the course of construction projects to identify key areas of delay. He is well-versed in applying a number of tools and techniques for project delay analysis on both a prospective and retrospective basis.

    Marina Boules | TR ConsultMarina Boules

    Marina graduated from the University of Portsmouth, with a Bachelor of Law degree. During her studies, Marina volunteered at a Legal Advice Clinic, where she demonstrated a keen interest in contract and land law. Valuable experience was also gained in conducting legal research, contract negotiations, handling legal and confidential documents and advising clients on legal matters.

    Since joining Tudor Rose, Marina has been involved in a number of high profile projects, supporting the team with legal research and data management. Marina also ensures that all submission bundles are prepared and submitted on time and to the highest standard.

    Prior to specialising in dispute resolution, Roger worked as a quantity surveyor for various contracting organisations where he progressed to managing surveyor. He understands, first hand, how disputes can arise and how they can potentially be avoided. He fully appreciates the significance of commercial reality when a dispute does arise.

    Roger has extensive experience of advising and representing parties on all commercial aspects and alternative dispute resolution on a variety of construction projects. His involvement spans the entire dispute resolution process from initially advising clients on entitlements and strategy, before a dispute crystallises, through to the enforcement of adjudicator’s decisions and representation in arbitration/advice on litigation.

    Roger has prepared and managed the preparation of numerous claim documents to establish and resolve quantum and time entitlement, whether by direct negotiation or by representation in mediation, adjudication or arbitration.

    Roger is a qualified adjudicator and is on the RICS Low Value Dispute panel and the UK Adjudicators panel.

    Roger has experience of being appointed as Quantum Expert both in litigation and in arbitration.

    Roger is also experienced in conducting seminars and workshops, providing retained visits to clients to advise on contractual matters as and when they arise and has carried out expert determination where jointly appointed by parties to a dispute.

    Pat Barry

    Pat is an experienced Quantity Surveyor with extensive experience in the commercial management of construction projects and settlement of construction disputes.

    During his career, Pat has worked with a number of main contractors, specialist sub-contractors and large residential developers which has provided him with broad experience and understanding of the issues affecting the successful delivery of construction projects for many different types of organisations.

    Pat initially qualified with a diploma in civil engineering and commenced his career in construction as an engineer with a structural steel sub-contractor. He subsequently worked as an estimator/manager for a scaffolding sub-contractor prior to undertaking his qualification and training as a Quantity Surveyor with a variety of main contractors in Ireland. He then took up the opportunity to work as an estimator/quantity surveyor for a main contractor in New York before returning to the UK to take up a position as managing quantity surveyor for a specialist façade contractor. He then progressed to commercial director for a main contractor before working as a commercial manager for a large residential developer.

    Pat has a strong understanding of all standard forms of contracts with a particular focus on the JCT, having been actively involved in reviewing and negotiating contract amendments and risk allocation in his role as commercial director for a main contractor. This role also involved implementing systems to monitor, control and report on the commercial status of projects. He has been actively involved in the administration of contracts as part of his commercial manager and quantity surveying roles. He has extensive experience in the preparation of final accounts and claims, as well as the valuation and assessment of change and claims for loss and expense.

    He has also advised, represented, and supported his employers in structured negotiations, mediation and adjudication proceedings, including the drafting of submissions.

    Before joining Tudor Rose, Neil gained experience on a number of major infrastructure projects, including roles in cost management, contract administration, estimating and audit.

    Since joining Tudor Rose, Neil has been extensively involved in providing project monitoring services, delay analysis, audit, compliance, claim preparation support and commercial management advice to a variety of clients operating in the construction industry. Neil has developed significant expertise in identifying risk, providing strategic commercial advice and analysing complex contractual mechanisms and data to establish and calculate further entitlements to both time and money on a broad variety of construction projects, from high end residential to public infrastructure framework agreements.

    He has used his experience to assist a variety of clients in identifying issues surrounding compliance and commercial risks, providing practical advice on mitigating and resolving the impact of these risks. This has included a range of issues including; providing contractual and commercial advice (including the research of issues and preparation of correspondence) on matters affecting live projects; developing systems for reporting and managing issues of non-compliance; and providing strategic commercial management of claims throughout the supply chain. He has extensive experience in analysing delays affecting projects and preparing detailed claim documents and submissions for both time and money. Neil has provided practical advice on these issues to staff at all levels for a variety of clients.

    Neil has actively advised, represented and supported numerous parties in various forms of dispute resolution, including structured negotiations, adjudication, arbitration and mediation proceedings. This has enabled Neil to provide advice to client, consultancy and contracting organisations. This has regularly required Neil to provide ad-hoc advisory services to clients and to deliver structured training.

    Natalie is an experienced mediator. In April 2020 Natalie became a CEDR Accredited Mediator building on her November 2016 RICS accreditation. Both accreditations recognised the years of successful mediations she has conducted in the fields of anti-social behaviour, social housing and family issues and the construction mediations she has been involved with as a party representative.

    Natalie was admitted to the Roll as a Solicitor in February 2012 following a period of secondment to Bond Dickinson (Womble Bond Dickinson) and work experienced gained at Tudor Rose. Natalie is currently a nonpractising solicitor.

    Since joining Tudor Rose in early 2008 Natalie has applied her skills entirely to the resolution of contractual and legal problems within the construction sector.

    Natalie is fully conversant with key issues that pertain to the successful commercial management of construction projects together with the various standard form construction contracts (JCT, NEC etc.), and the typical bespoke amendments that may dramatically alter the risk profile of such contracts.

    In the last 12 years Natalie has worked alongside the Directors and Associates of Tudor Rose to bring or defend a significant number of adjudications, the vast majority of which have been successfully concluded. Natalie has also gained extensive experience in the collation of evidence and the preparation of Adjudication documentation with the various forms of jurisdictional protest that may be validly raised when faced with a reference to adjudication.

    Since joining Tudor Rose Natalie has successfully completed the MSc in Construction Law and Dispute Resolution at Kings College, London with Merit. Natalie received a Distinction for her dissertation on the use of evidence in statutory adjudication and now applies her findings to the way in which she prepares and submits evidence in the adjudications in which she is involved.

    Natalie was Called to the Bar in 2003 and initially worked in Civil and Employment law which developed her interest in Dispute Resolution.

    Monika joined Tudor Rose in 2014. In her role as Office Manager, Monika is responsible for the day to day management of the business, supported by the administration team.     Michael McKee | TR ConsultMichael McKee

    Having graduated with an Honours degree in Quantity Surveying, Michael initially commenced his career with a mechanical contractor who specialised in the provision of ventilation systems. In addition to his day-to-day quantity surveying duties, Michael was actively involved in the preparation of tenders, procurement of materials and subcontractors as well as the overall management of projects.

    Michael subsequently took the position of Quantity Surveyor on the construction of a new airport in the Middle East on behalf of a JV contractor. Michael’s primary role was the management of the subcontract packages. Additionally, he was responsible for the preparation of variations under the main contract and played a key role in the proposal and presentation of value engineering solutions for key systems, together with their implementation.

    Since returning to the UK, Michael worked as a Quantity Surveyor on behalf of both employer and contractor on various projects. In this role he has assisted his clients in establishing entitlement to variations as well as loss and expense/damages, culminating in the preparation of accounts to ‘adjudication standard’. Michael has also provided his clients with support on discrete contractual matters with a view to avoiding disputes. Where this was not possible, Michael has represented his clients in adjudication, mediation and conciliation.

    Mark McTighe | TR ConsultMark McTighe

    Mark comes from a project controls background and has significant experience working on live projects in the aviation and rail sectors. Having previously worked with clients, consultants and main contractors, he has a keen understanding of the drivers that underpin successful outcomes for each party.

    Prior to joining Tudor Rose, Mark held the position of Project Controls Lead for a JV undertaking a large underground rail contract in central London. This role primarily consisted of producing period-end programme, cost, performance and risk deliverables within an NEC framework. In addition to these duties, he was frequently called upon to support contract change, disallowed cost and target cost negotiations.

    Since joining Tudor Rose Mark has been heavily involved supporting clients in maximising the value of their projects, including through adjudication proceedings. Mark has a detailed knowledge of all commonly used delay analysis methodologies and is able to quickly select the most appropriate to use given the circumstances of a dispute. Mark is also adept at undertaking forensic analyses of the available evidence which allows him to take a targeted approach on the causes of critical delay to a project.

    Mark is highly proficient in the use of planning and project controls software including Oracle Primavera P6, Asta Powerproject, Deltek Cobra, MS Project, Enterprise Bentley and Cemar. Mark is committed to continuing professional development, and in addition to his continuing membership of the Society for Construction law and the Association for Project Management, he will be undertaking the MSc Construction Law and Dispute Resolution at Kings College London from September 2021.

    Mark Hamber | TR ConsultMark Hamber

    During his time with Tudor Rose, Mark has provided advice and support to and on behalf of main contractors during formal dispute proceedings. Mark has also assisted main contractors in interrogating and particularising claims in order to provide information to appointed Quantum Experts on major disputes. He has knowledge and experience of operating the major standard forms of contract in order to compute and present submissions for both time and money.

    Mark has managed project teams to identify, demonstrate and agree changes incurred during a projects lifespan. This has included instigating and maintaining the required standard of record keeping, subsequently using such information to prepare submissions demonstrating contractual entitlement on behalf of main contractors.

    Prior to joining Tudor Rose, Mark worked as a quantity surveyor for national main contractors across a broad range of construction project types. Through this breadth of experience, he has had the opportunity to develop his knowledge and understanding of the characteristics of different types of construction projects, along with the associated problems which may arise during the course of the works. During this time, Mark gained experience in all aspects of commercial management within contracting organisations, at both project and corporate levels.

    During his career, Mark has gained extensive first-hand experience of preparing and computing delay and quantum claims. He has been involved in all aspects of claim preparation for the purpose of pursuing and defending claims. Mark is well versed in all aspect of claims management from claim preparation; assessment of entitlement; and negotiation through to agreement, without the need to seek recourse through a tribunal. Mark continues to put this experience to good use, combining it with his knowledge and understanding of formal dispute resolution processes.

    Following his initial undergraduate studies, Mark completed a Masters degree in Construction Law and Arbitration, receiving a distinction for his final year dissertation. He is now working towards fellowship status within the CIArb. Mark’s professional knowledge and experience, combined with this continuing academic progression, provides him with the necessary expertise to provide advice and support in the resolution of complex commercial and contractual issues.

    Lauren Bodkin | TR ConsultLauren Bodkin

    Lauren is Receptionist and PA to the Directors. She is the first point of contact for all clients attending or phoning the office. She is responsible for scheduling meetings, monitoring of the conference rooms as well as for all travel arrangements. In her day to day role, Lauren also supports the Office Manager and the Administrator with general office duties and administrative tasks.

    Ayan Maydhane | TR ConsultAyan Maydhane

    Ayan joined Tudor Rose in 2016. In her role as Administrator, Ayan works alongside the Office Manager assisting with day to day running of the office. Ayan provides administrative support to the team and is responsible for procurement of office equipment and supplies. She also works closely with the Commission Support team and assists with the preparation and issue of submissions to meet deadlines.

    Tudor Rose Lance BuchananLance Buchanan

    Lance is a Chartered Quantity Surveyor with commercial and project management experience in all pre-contract, project establishment, post-contract and post-completion duties. This has given Lance a keen eye for the early identification of potential issues and a sound commercial awareness of construction.

    Since joining Tudor Rose, Lance has gained experience working on a variety of construction and engineering projects ranging from large infrastructure schemes to prestigious residential developments. He has been engaged to carry out a variety of tasks including cost control, estimating, contract administration, identifying project risk whilst providing commercial support and advice both during the project phase or as part of his involvement during claim preparation and negotiation and/or the dispute resolution stage.

    Lance is proficient in the use of all commonly used contract forms including JCT, NEC, ICE, PPC, in addition to bespoke agreements. He is particularly adept at carrying providing quantum analysis and commercial advice in relation to final accounts, valuation of change, interim assessments on complex valuation payments, defects and assessment of damages. He has provided support in the production and drafting of expert reports and he regularly supports the Directors in the representation of parties in adjudication and mediation proceedings.

    Having experience with all parties in the supply chain, Lance has also provided advice and strategic support on the implementation of project systems where he has engaged in the forensic assessment of projects including reviewing evidence relating to extension of time claims, project monitoring, report compliance and audit management.

    Lance was awarded the Society of Construction Law prize for best performance in his first year of the Construction Law & Dispute Resolution MSc course at King’s College London and will finish his studies in late 2021. Lance is also working toward attaining Fellowship with the CIArb.

    James Carter

    James is an experienced Chartered Civil Engineer and Planning Manager with other twenty years’ experience in the planning and delivery of major civil engineering projects including resolution of disputes and matters of delay. Major project experience includes extensive new build rail, highway, airports and building projects throughout all project stages from feasibility to project closedown. James has experience in both managing the Planning function on major civils projects as well as delivering planning/Project Control’s solutions.

    James has held key Planning roles in consultancy, client and main contractor organisations and has significant experience in both the preparation and defence of claims for extension of time under different forms of NEC contract. Prior to moving into dispute resolution and project planning, James trained as a Civil Engineer specialising in highway design and managing multidisciplinary engineering teams.

    An expert user of Primavera P6 and competent user of other recognised industry planning tools such as Microsoft Project, Acumen Fuse, Primavera Risk and excel, James has provided Planning Masterclass training within Main contractor organisations.

    Helen Caudrey | TR ConsultHelen Caudrey

    Helen has over 18 years of experience within the construction industry and has carried out the contract administration and project management functions on a diverse array of complex projects with values up to £100 million. She is a Chartered Building Surveyor and has successfully completed the RICS Diploma in Adjudication.

    Helen has practical working knowledge of the various standard forms of contract and has gained extensive experience using and administering the JCT suite of contracts. Prior to specialising in the field of dispute resolution, Helen trained as a Building Surveyor and subsequently moved to project management, achieving specialist expertise in contract administration on behalf of developers on luxury hotel, residential, education, hospitality and mixed use developments.

    Gary Shadlock

    Gary has over 33 years experience within the construction industry and, prior to specialising in dispute resolution, Gary worked as a Quantity Surveyor for a variety of contracting organisations. This has enabled Gary to obtain a broad understanding of issues affecting the successful delivery of construction projects, including issues surrounding entitlement to time and money.

    Gary has extensive experience in the management and settlement of major construction disputes, having provided advice to contractors and client organisations on issues affecting all aspects of the project life cycle, from procurement through to the resolution of the final account process. This has enabled Gary to provide advice and support to employers and contractors in the preparation and settlement of complex construction projects and has included the preparation of detailed claim documents and submissions across a broad spectrum of standard form of bespoke contracts.

    Gary has acted as an expert witness and party representative in adjudications for employers, main contractors and subcontracting organisations in respect of quantum and delay issues. This has required Gary to advise, represent and support parties in structured negotiations (including mediation) and adjudication proceedings.

    Tudor Rose David ClancyDavid Clancy

    David began his career as Quantity Surveyor for a Main Contractor working on a number residential and commercial projects. David was responsible for sub contract procurement and management including assessing variation and loss and expense claims. David furthered his learning of quantity surveying by becoming a professional member of the RICS.

    David moved to Australia in 2011 to pursue an opportunity with a large multinational contractor, here he was exposed to large rail and civil projects before progressing quickly to become the lead commercial resource for the rail business unit in Sydney. During this time, he gained vast experience in negotiating contractual terms, loss and expense claims and agreeing final accounts.

    David then began work for a construction consultancy where he worked as a senior consultant on the resolution of large construction disputes. His role included, assisting in the drafting of Expert Witness reports (delay and quantum), preparing loss and expense claims, submitting and agreeing variation and extension of time claims along with preparing training manuals and providing general contractual advice to clients. David also has a comprehensive knowledge of different delay analysis techniques and is proficient in the use of Primavera P6 to prepare detailed delay analyses and in the preparation of extension of time claims.

    David has a keen attention to detail and is well versed in the preparation of ‘adjudication ready’ final accounts. His first-hand experience of working on site for a main contractor along with his work in the preparation of expert witness reports ensures that David has a full breadth of understating of dispute resolution processes.     Daniela Stambrow | TR ConsultDaniela Stambrow

    Daniela graduated from the University of London with a 2:1 Bachelor of Law degree, having a particular interest in Contract and Property Law. In tandem with her studies, Daniela was employed by an international organisation where she gained a variety of legal experience including the creation of company invoices, website terms and conditions, employment contract clauses as well as being responsible for legal research within her department.

    In Daniela’s time at Tudor Rose, she has played an active role in a number of high-profile commissions with Project values ranging from £100million to £1.5billion. Daniela has undertaken various fundamental roles on both live and completed projects, such as providing essential commercial support, dealing with complex insurance claims and often appointed to carry out forensic reviews of evidence for use by Counsel.

    Daniela is currently supplementing her practical experience by studying for a Master of Science degree (MSc) in Construction Project Management to complement her Bachelor of Law degree (LLB). She has also been undertaking in-depth research into the relationship between successful negotiation and psychology for her chosen dissertation subject.

     Colin Pellatt

    Colin is an experienced Quantity Surveyor and Project Manager with extensive experience in the management of projects and settlement of major construction disputes.

    During his career, Colin has worked within contracting, consultancy and client organisations. This has provided him with broad experience and understanding of the issues affecting the successful delivery of construction projects for many different types of organisation.

    Prior to specialising in the field of dispute resolution, Colin trained as a Quantity Surveyor and subsequently achieved specialist expertise managing the delivery of construction projects on behalf of large technology and financial services organisations on an international basis. Colin has successfully delivered many construction projects, ensuring that primary organisational objectives, within the parameters of time, cost and quality, are met on every occasion. Colin continues to provide specialist support and advice on the delivery of construction projects.

    Colin has extensive experience and expertise in the management and settlement of major construction disputes. He has advised and supported employers and main contractors in the preparation and commercial settlement of substantial and complex contracts. Colin’s expertise in this field has enabled him to provide regular advice to clients on matters of effective contract strategy and procurement. This work has routinely required the undertaking of detailed delay analysis exercises and the preparation of claim documents and submissions.

    He has also advised, represented and supported numerous parties in structured negotiations, mediations and adjudication proceedings, including the drafting of submissions.

    Carlo is a Quantity Surveyor who specialises in establishing entitlement for both quantum and time matters with a particular focus on project strategy and dispute resolution.

    Commencing his career as an architectural steel fabricator specialising in bespoke steelwork where he gained a wealth of practical site experience, Carlo quickly progressed his career and was offered a position as a Quantity Surveyor for an M&E contractor, before moving to a Quantity Surveying practice.

    Carlo has performed a variety of roles such as estimator, procurement manager, commercial manager and contract administrator. This breadth of experience has given Carlo a keen eye to analyse construction projects and establish entitlement. Carlo has a detailed understanding of the use and administration of all major standard form contracts and has provided guidance at all stages of construction projects.

    Since joining Tudor Rose, Carlo has provided contractual and commercial advice to clients, contractors and subcontractors alike. He is frequently appointed by his clients to provide strategic support on live commissions with a focus on the identification and management of commercial risk. He is also experienced in the assessment of time related matters using all delay analysis techniques and the calculation of associated damages. Carlo is well versed in the preparation of detailed final account documentation and frequently supports his clients to ensure that entitlement is captured. He has also been appointed as both quantum and delay expert in a number of adjudications proceedings.

    Carlo has played a key role in the settlement of a variety of disputes without the need of formal proceedings, by preparing robust forensic analyses and supporting documentation for both delay and quantum matters. This has led to the successful negotiated settlement of disputes where Carlo has provided input during the negotiation and the settlement agreement. On occasions where Carlo has been appointed in the later stages of a project or when a dispute cannot be resolved amicably, Carlo has acted as party representative in a number of successful adjudication and mediation proceedings acting for both the referring and responding parties.

    In addition to his consultancy services, Carlo provides a variety of training courses to his clients on matters such a contract updates, measurement and delay principles. Carlo is also a guest lecturer at UCL’s Bartlett School of Construction and Project Management.

    Ross Taylor

    Ross is a Planner and Delay Analyst who specializes in the preparation and defence of claims for extensions of time.

    Starting his career with a Main Contractor, Ross worked as a Construction Manager across a broad range of commercial, residential, education, and mixed-use projects where he gained experience managing subcontractor packages throughout the construction process. During that time, he also gained exposure using risk management, trade coordination and project planning tools, as well as initial experience in the preparation of Contractor delay and disruption claims.

    Having a particular interest in the use and management of complex data, Ross supplemented his work experience with an MSc in Business Analytics. During that time, he used Applied Systems Dynamic Modelling to demonstrate how humanistic biases and rounding errors were leading to significant reporting errors in the project controls systems within major infrastructure projects underway.

    Ross subsequently accepted a position with a project management consultancy. Although Ross was initially engaged as a project manager, he quickly found his skills were and data management abilities made him particularly adept at programming and he transitioned into a dedicated programme and planning management position. He advised clients on all elements of programme strategy as well as monitoring and coordination of live construction projects. This often led to further works in Delay and Disruption, and ultimately to his role as a witness on a number of Adjudications acting in defence of a number of his clients.

    Ross is proficient in a range of planning and project management software tools and is experienced in the use of various delay techniques.
